Former Switchboard Software employee alleges he is still owed unpaid wages

SAN FRANCISCO – A Belmont man alleges his former employer has failed to pay him all wages owed.

Stephen Tsang filed a complaint on Nov. 1 in the San Francisco Superior Court against Switchboard Software Inc. and Does 1 through 5 alleging breach of contract, violation of state labor code and other counts.

According to the complaint, on June 11, Tsang informed the defendant that he would be resigning from his head of sales position and requested to receive his final sales and commission earned amounting to $92,600. 

He alleges he declined the defendant's offer of $25,000 to resolve all employment matters. He also alleges he received a check of $1,640.42 for paid time off, but this check was returned due to insufficient funds.

The plaintiff alleges he was not timely paid and still has not been paid all wages that he lawfully earned during his employment. 

The plaintiff requests a trial by jury and seeks judgment for damages, statutory penalties, pre- and post-judgment interest, declaratory judgment, attorneys' fees, costs of suit and for such and further relief as the court deems just and proper.
