FRESNO – A Riverdale limited liability company is alleged to have failed to pay for almost 450 tons of hay.

Rimon Farms LLC filed a complaint on Oct. 30 in the Fresno County Superior Court against Maggini & Son Trucking LLC and Does 1-10 alleging breach of contract and other counts.

According to the complaint, the plaintiff owns property in Kern County and in May, it entered into a contract with the defendants for the purchase, removal and sale of hay on the property. The suit states the defendants removed roughly 450 tons of hay in May and June, totaling more than $101,000 per the agreement.

The plaintiff holds Maggini & Son Trucking LLC and Does 1-10 responsible because the defendants allegedly breached their obligations under the agreement and refused and continue to refuse to pay any monies to plaintiff as required under the oral agreement.

The plaintiff seeks judgment against defendants for the principal sum of $101,864.89, costs of suit, punitive damage and further relief as the court deems just. It is represented by Dirk B. Paloutzian and Daniel C. Stein of Baker Manock & Jensen PC in Fresno.
