FRESNO – Two Fresno consumers allege a Ford vehicle they purchased has defects and are seeking rescission of the sales contract.
Maria Estrada and Salome Estrada filed a complaint on Oct. 30 in the Fresno County Superior Court against Ford Motor Co. and Does 1-10 alleging violation of the Song-Beverly Consumer Warranty Act and the Magnuson-Moss Warranty Act.
According to the complaint, the plaintiffs purchased a 2016 Ford Fusion on Aug. 29, 2015, and that the vehicle came with warranties. They allege the vehicle was delivered to them with serious defects and nonconformities to warranty including but not limited to various engine, transmission, steering/suspension, HVAC, electrical and structural defects. They allege these defects impair the use, value and safety of the vehicle.
The plaintiffs hold Ford Motor Co. and Does 1-10 responsible because the defendants allegedly were unable to repair the nonconformities despite a reasonable number of attempts.
The plaintiffs request a trial by jury and seeks judgment against defendants for general, special and actual damages; rescission of the purchase contract; diminution in value; incidental and consequential damages; civil penalty; interest; attorney's fees; and costs of suit, and further relief as the court deems just.
