Cyclist seeks damages from City Wide Maintenance over collision in Fresno

FRESNO – A cyclist is seeking damages from a driver and his employer after he was allegedly struck near a Fresno intersection.

Alexander Cruz filed a complaint on Nov. 6 in the Fresno County Superior Court against Daniel Keith Patton, City Wide Maintenance Inc. and Does 1 through 50 alleging negligence.

According to the complaint, on Nov. 29, 2016, Cruz was riding a bicycle near the intersection of North Weber and North Marks avenues when he was struck by a white 2006 GMC Sierra owned by defendant City Wide and operated by defendant Patton. As a result, Cruz claims he suffered severe injuries to his head, back, neck and pelvis.

The plaintiff alleges the defendants negligently, carelessly and unlawfully entrusted, managed, maintained, drove, and operated a vehicle so as to cause the vehicle to collide with his bicycle.

The plaintiff seeks judgment for general and special damages, costs of suit, and such other and further relief as the court deems just and proper. He is represented by David F. Makkabi, Karla Ruiz and Matthew P. Foose of Makkabi Law Group in Beverly Hills.
