PetSmart employee alleges he was terminated in retaliation for supporting harassment claims

FRESNO – A man alleges his was terminated from his position from a pet store for supporting a subordinate employee's claims of harassment.

Timothy Thompson filed a complaint on Nov. 7 in the Fresno County Superior Court against PetSmart Inc. and Does 1-50 citing the Fair Employment and Housing Act.

According to the complaint, the plaintiff was hired by PetSmart in 2002 and eventually became assistant store leader of the Riverpark Fresno location. He alleges a female employee told him she felt harassed and discriminated against by the store leader and he recommended she file a complaint with human resources. He alleges within days of this recommendation, he was terminated May 31.

The plaintiff holds PetSmart Inc. and Does 1-50 responsible because his engagement in protected activity alleged was a motivating reason for the defendant to terminate him.

The plaintiff requests a trial by jury and seeks reinstatement of his employment, damages, declaratory relief, attorney fees, costs and for such other and further relief as the court may deem proper. He is represented by John L. Migliazzo of Michael J.F. Smith, a professional corporation in Fresno.
