Sojourn Hospice and Palliative Care - Fresno social worker files suit over termination

FRESNO – A social worker alleges she was retaliated against for reporting allegedly unlawful activity.

Courtney Miller filed a complaint on Nov. 7 in the Fresno County Superior Court against Sojourn Hospice and Palliative Care - Fresno LLC and Does 1-10 alleging whistleblower retaliation and other counts.

According to the complaint, the plaintiff was employed by the defendant as an associate clinical social worker and began working for the defendant in 2015. She alleges she reported allegedly unlawful and unethical conduct to the Department of Health and Human Services Tips Fraud Hotline in January and throughout the course of the year, her patient load dwindled to nothing. She alleges she never received a formal notice of termination 

The plaintiff holds Sojourn Hospice and Palliative Care - Fresno LLC responsible because the defendant allegedly stopped assigning patients to her, which ultimately led to her termination.

The plaintiff requests a trial by jury and seeks judgment for economic and non-economic damages, punitive damages, prejudgment interest, costs and such other and further relief as the court deems just and appropriate. She is represented by Elizabeth M. Peck of Peck-Law in Santa Cruz.
