National Raisin alleges Ikon Express failed to deliver raisins

FRESNO – A Fresno County transportation company is alleged to have failed to deliver more than $300,000 worth of raisins as agreed in a contract.

Sunshine Raisin Corp., doing business as National Raisin Co., filed a complaint on Nov. 8 in the Fresno County Superior Court against Singh, individually and doing business as Ikon Express Inc.; Ikon Express Inc.; and Does 1 through 50 alleging breach of contract and other counts.

According to the complaint, on Aug. 7, parties entered into a partly oral and partly written agreement whereby the plaintiff agreed to pay defendants to haul shipping containers from the shipping port in Oakland and to deliver the containers to the plaintiff in Fowler.

The plaintiff alleges the defendants took possession of the seven shipping containers of raisins and failed and refused to deliver them as agreed.

The plaintiff holds the defendants responsible because the defendants allegedly defaulted under the terms of the agreement and have converted the plaintiff's property for its personal use.

The plaintiff requests a trial by jury and seeks judgment for actual damages in an amount not less than $336,732, interest, exemplary and punitive damages, such other and further relief as the court may deem just and proper. It is represented by Don J. Pool of Dowling Aaron Inc. in Fresno.
