Wind Fall Farms I alleges pomegranate farm's failure to maintain property caused insect issues

FRESNO – A Fresno County almond farm blames a neighboring organic pomegranate farm for an insect infestation that damaged its crop.

Wind Fall Farms I filed a complaint on Nov. 8 in the Fresno County Superior Court against Ignacio and Casamira Sanchez, both doing business as Twin Girls Farms, and Does 1-50 alleging private nuisance, negligence and trespass.

According to the complaint, the plaintiff's almond farm is adjacent to the plaintiff's pomegranate farm. The plaintiff alleges in 2017, the defendants failed to maintain the property and inspect for insect infestations, and as a result it became infested with the Western leaffooted bug. The plaintiff alleges the insects spread to its almond orchards and caused significant damage.

The suit states the plaintiff has demanded for the defendants to compensate it for its losses and that they failed to do so, and they allegedly continue to ignore their property.

The plaintiff holds Ignacio and Casamira Sanchez and Does 1-50 responsible because the defendants allegedly failed to use industry customs and best practices in farming to maintain their property.

The plaintiff requests a trial by jury and seeks judgment against defendants for damages of more than $400,000, costs of suit, attorney's fees, and further relief as the court may deem just and proper. It is represented by David S. Pearson of Law Offices of David S. Pearson in Walnut Creek.
