MM Construction alleges it is owed more than $200,000 for work on San Francisco property

SAN FRANCISCO – A San Francisco County construction company alleges it was not paid in full for work on a project.

Emery Cos. Inc., doing business as MM Construction, filed a complaint on Nov. 21 in the San Francisco Superior Court against 69 Maiden Owners LLC and Does 1 through 50 alleging breach of contract, unjust enrichment and other counts.

According to the complaint, Dec. 13, 2016, as a direct contractor, the plaintiff entered into a written construction contract with the defendant whereby plaintiff provided general contracting services, labor, materials and equipment for the construction of the shell and core of the work for improvements at defendant's San Francisco property. 

The plaintiff alleges it has performed all of its obligations under the contract but despite demand, it is still owed $221,512.25 from the defendant.

The plaintiff requests a trial by jury and seeks judgment in the sum of $221,512.25 together with interest and penalties, costs of suit, attorney's fees and such other and further relief as the court may deem just and proper.
