Bicyclist seeks damages over Stockton collision

STOCKTON – A Stockton man is seeking damages after he was struck while riding a bicycle.

James Robert Gomez filed a complaint on Dec. 7 in the San Joaquin Superior Court against Maxwell Barth, Peter Blair Barth and Does 1 through 50 alleging negligence.

According to the complaint, on May 24, 2017, Gomez was riding his bicycle near the intersection of El Dorado Street and Iris Avenue in Stockton when he was involved in a collision with defendants' vehicle and was injured.

The plaintiff holds Maxwell Barth, Peter Blair Barth and Does 1 through 50 responsible because the defendants allegedly operated, controlled and maintained their vehicle in a negligent and careless manner.

The plaintiff requests a trial by jury and seeks judgment for general and special damages, costs of suit, and such other and further relief as the court may deem just and proper. He is represented by Laura F. Sedrish, Bretil Beitmirza and Jubin J. Niamehr of Akiva Niamehr LLP in Los Angeles.
