Account executive alleges she was wrongfully terminated by Nexstar Broadcasting

FRESNO – A Fresno County woman alleges that her former employer failed to engage in an interactive process to accommodate her medical condition.

Andrea Andrade filed a complaint on Dec. 4 in the Fresno County Superior Court against Nexstar Broadcasting Inc. and Does 1 through 100 alleging wrongful termination and other counts.

According to the complaint, the plaintiff was hired by the defendant in 2015 as an account executive outside salesperson. The suit states she was diagnosed with endometriosis in July 2016 and that she suffered from painful symptoms.

On Jan. 25, 2017, the suit states the plaintiff was informed by the defendant that it was terminating her employment for her alleged excessive tardiness in violation of Nexstar's attendance policy. 

The plaintiff holds Nexstar Broadcasting Inc. responsible because the defendant allegedly failed to timely engage in an interactive process in good faith to reasonably accommodate plaintiff's actual or perceived physical disabilities and/or medical conditions.

The plaintiff requests a trial by jury and seeks money judgment for damages, injunctive relief, pre- and post-judgment interest, attorney fees, costs of suit, and for all other relief the court deems proper. She is represented by Charles Trudrung Taylor of Lang, Richert & Patch in Fresno.
