Property owner files breach of contract suit against Occidental Express, others

SAN FRANCISCO – The owner of a 20th Street, San Francisco property alleges a contractor used unfair and deceptive business practices.

Gina Emett filed a complaint on Dec. 7 in the San Francisco Superior Court against Henry Karnilowicz, doing business as Occidental Express; Wesco Insurance Co. and Does 1 through 30 alleging breach of contract and other counts.

According to the complaint, on April 2015, Emett was induced by Karnilowicz to enter into a purported home improvement construction goods and services contract for the agreed price of $57,840. 

The plaintiff alleges Karnilowicz falsely represented construction services would be provided through Occidental Express, that the documents did not comply with the California Contractor Licensing and Construction Laws, and that Karnilowicz failed to complete the project for the agreed-upon contract price.

The plaintiff seeks judgment for attorney's fees, costs of suit, and such other, further or different relief as the court deems just and proper. She is represented by Daniel Bornstein and Kathryn Quetel of Bornstein Law in San Francisco.
