Painter alleges Saarman Construction, others failed to provide fall protection for scaffolding

SAN FRANCISCO – A painter is suing the general contractor and subcontractor of a San Jose construction project after falling from scaffolding.

Santos Salvador Martinez and Anna Nunez Martinez filed a complaint on Dec. 17 in the San Francisco Superior Court against Saarman Construction LTD, Custom Scaffold Inc., The Irvine Co. LLC and Does 1-100 alleging negligence and other counts.

According to the complaint, on Oct. 5, 2017, Santos Salvador Martinez was employed as a painter by Universe Painting Inc. and participating in the renovation project of the defendants in San Jose. He alleges he fell from scaffolding at an elevated height while on the job site and sustained significant injuries to his left leg.

The plaintiffs hold the defendants responsible because the defendants allegedly failed to provide fall protection and adequate access and egress to the scaffolding and to the scaffolding's different levels.

The plaintiffs request a trial by jury and seek judgment for general and special damages, costs of suit, and such further relief as the court may deem proper. They are represented by Robert B. Abel Jr. of Law Offices of Robert B. Abel Jr. in San Francisco.
