Man alleges individual bit his finger off during altercation at Denny's restaurant

SAN FRANCISCO – A Los Angeles County man alleges an Alameda County man bit off one of his fingers at a Denny's restaurant in San Francisco.

Rahim Ali filed a complaint on Dec. 14 in the San Francisco Superior Court against Ayaz Virji and Does 1 to 20 alleging assault, battery and intentional infliction of emotion distress.

According to the complaint, on Jan. 12, Ali and Virji were seated together with other individuals in a booth at a Denny's restaurant in San Francisco. The suit states the defendant had been drinking alcohol during the course of the evening. 

The plaintiff alleges the defendant took offense to a comment made and punched him. The suit states the defendant also threw him to the floor and bit the fifth finger off of the plaintiff's right hand.

The plaintiff holds Virji responsible because the defendant allegedly intended to cause and did cause harmful contact with plaintiff.

The plaintiff requests a trial by jury and seeks judgment for all damages, costs of suit, attorney's fees and for such other and further relief as the court may deem proper. He is represented by Arne J. Nelson of Law Offices of Arne J. Nelson in Oakland.
