Tenant of Fresno property alleges unit is unsanitary

FRESNO – A tenant of a Fresno unit alleges that the property owners failed to repair unsanitary conditions.

Jose Antontio Acosta Leon filed a complaint on Dec. 21 in the Fresno County Superior Court against Mohammed Hauter Trustee of M S Hauter Family TR DTD 9-20-03 and Does 1-50 alleging failure to provide habitable dwelling and other counts.

According to the complaint, in October 2013, Acosta Leon became a tenant at defendants' multi-family residential property at Hammond Avenue in Fresno. He alleges the unit has evidence of an insect infestation and other unsanitary conditions throughout the unit. He alleges the defendants have not repaired the issues despite numerous requests.

The plaintiff alleges the defendants failed to provide a habitable premises.

The plaintiff seeks judgment for damages, attorney's fees, costs of suit, and such other relief as the court may deem just and proper. He is represented by Margaret A. Elder and Chandra Gehri Spencer of Elder & Spencer LLP in Fresno.
