Woman seeks damages from owners of San Francisco apartment after balcony detached from building

SAN FRANCISCO – A Los Angeles resident is seeking damages from the owners and managers of a San Francisco apartment after a third-floor balcony she was standing on detached from the building and fell.

Akane Shiba filed a complaint on Jan. 3 in the San Francisco County Superior Court against George N. Mainas, Maria K. Mainas, George Goodwin Realty Inc. and Does 1-10 alleging negligence and premises liability.

According to the complaint, on Oct. 26, 2018, the plaintiff was attending a Halloween party at an apartment on the third floor of defendants' building when the balcony she was standing on detached from the stucco wall and fell to the street below. She alleges she sustained a skull fracture, brain injury, facial nerve paralysis, impaired hearing and a broken arm.

The suit states the balcony was solely decorative and not occupiable and the defendants allegedly failed to take action to render it nonoccupiable or add additional structural support in accordance to load requirements.

The plaintiff requests a trial by jury and seeks judgment against defendants for noneconomic and economic damages, costs of suit, interest, and further relief as the court may deem proper. She is represented by John M. Feder of Rouda Feder Tietjen & McGuinn in San Francisco.
