Woman alleges M.B.S. Property Management wrongfully terminated her

Lawsuits
Wrongful term 09

FRESNO – An Orosi resident alleges she was wrongfully terminated from her employment with a property management company for reporting alleged violations of the law.

Berta Brown filed a complaint on Jan. 9 in the Fresno County Superior Court against M.B.S. Property Management Inc. and Does 1 through 10 alleging wrongful termination and other counts.

According to the complaint, on Feb. 27, 2018, Brown became a resident manager for the defendant and earned approximately $15 per hour. While working for defendant, she alleges she noticed "numerous instances of defendant charging their tenants on overage due to defendant's failure to post their rent on time." She also alleges the defendant failed to complete tenants' re-certification in order to meet the U.S. Department of Agriculture-Rural Development regulations and tenants were excessively charged for their rent as a result. She alleges she immediately brought the matter to the attention of the regional manager.

The plaintiff alleges she brought up concerns again in May 2018 and she was terminated the same month.

The plaintiff holds M.B.S. Property Management Inc. responsible because the defendant allegedly unlawfully retaliated against her.

The plaintiff requests a trial by jury and seeks judgment for all damages, pre- and post-judgment interest, costs of suit, attorneys' fees, and such other and further relief as the court may deem just and proper. She is represented by Roman Otkupman and Meghan Maertz of Otkupman Law Firm in Agoura Hills.
