Jones Day issued the following announcement on Jan. 24.
John Vogt, a partner in Jones Day's Cybersecurity, Privacy & Data Protection Practice, has been named to the California Daily Journal's list of "Top Cyber Lawyers" for his work advising credit reporting agencies and online marketing service providers on complex and high-profile cybersecurity, privacy, and data protection matters. Of particular note was his role as lead lawyer in the more than 50 consolidated matters in Ohio and Arizona, filed under the Fair Credit Reporting Act, over the treatment of suspicious mail.
Mr. Vogt obtained summary judgment in the bellwether cases in both jurisdictions, with the district courts unanimously ruling that, unless a "consumer" himself or herself submits a dispute "directly" with a consumer reporting agency, longtime client Experian has no legal duty to conduct a reinvestigation of that dispute, regardless of whether Experian correctly deemed the dispute to be “suspicious.”
This is the second consecutive year Mr. Vogt has been named to this list.
