Driver alleges Coalinga man hit him without provocation, took cellphone

FRESNO – A disabled veteran has filed suit against a Coalinga man over allegations the man assaulted him and took his cellphone.

Gregory Cody filed a complaint on Jan. 16 in the Fresno County Superior Court against David Joe Scott and Does 1-10 alleging assault.

According to the complaint, the plaintiff alleges that on Aug. 25, 2018, while he was driving his automobile in the area of North Monterey Avenue in Coalinga. He alleges the defendant ran in front of his vehicle, forced him to stop, and pounded on the plaintiff's vehicle's hood. The suit states the defendant went to the driver's side window of the plaintiff's car, hit the plaintiff without provocation, and took the plaintiff's cellphone when he attempted to contact police.

The suit states the plaintiff drove to the Coalinga police department to report the incident and the defendant was arrested on charges of robbery and battery.

The plaintiff holds Scott and Does 1-10 responsible because the named defendant allegedly acted with the intent to cause harm or offensive contact.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory, general, special and punitive damages; interest; attorneys' fees; costs of suit; and further relief as the court deems just.
