Fred Loya Insurance seeks $8,500 subrogation payment from driver

FRESNO – An insurance company is seeking damages from a driver who allegedly backed into a pedestrian.

Fred Loya Insurance filed a complaint on Feb. 8 in the Fresno County Superior Court against Alejandro Garica Does 1-100 citing subrogation.

According to the complaint, on Feb. 20, 2016, the plaintiff provided insurance proceeds to its insured, Jose Diosdadozamora, after he sustained injuries when Garica backed into him. 

The plaintiff claims it made payments under the insured's policy for the uninsured motorist bodily injury costs in the sum of $8,500. The plaintiff is now seeking that amount from the defendant.

The plaintiff seeks judgment for the principal sum of $8,500, plus costs of suit incurred, and for such other and further relief as the court may deem just and proper. It is represented by Lee M. Mendelson and Marc A. Schwarz of Mendelson Goldman & Schwarz APC in Sherman Oaks.
