L&R Distribution alleges Tenter Enterprises failed to make payments under buyout agreement

OROVILLE – A Gridley company alleges that a Paradise company breached the terms of a buyout agreement.

L&R Distribution Inc. filed a complaint on Feb. 11 in the Butte Superior Court against Elliot D. Tenter, Tenter Enterprises Inc. and Does 1 through 10 alleging accounting, breach of contract and negligent misrepresentation.

According to the complaint, the plaintiff and defendants are independent package delivery contractors for FedEx for Butte County. The suit states in 2018, a contracted service area was available and the plaintiff and TEI agreed to a joint venture to acquire and operate it.

The suit states disagreements arose between the parties and a buyout was agreed upon in August 2018 for TEI to payments to the plaintiff. The plaintiff alleges the payment due dates have passed and the defendants have failed to make any payments.

The plaintiff holds Tenter and Tenter Enterprises Inc. responsible because the defendants allegedly breached the terms of the buyout.

The plaintiff seeks judgment for compensatory damages, prejudgment interest, costs of suit and for such other and further relief as the court may deem proper. It is represented by David R. Griffith of Griffith & Horn LLP in Chico.
