Mary's Gone Crackers alleged to owe more than $300,000 for rent

OROVILLE – A tenant of a Gridley property is alleged to have failed to pay rent in full.

Jaswant Singh Bains, trustee of the Jaswant and Satwant Bains Family Trust; and Roy Lanza, trustee of the Roy and Sondra Lanza Family Trust filed a complaint on Feb. 14 in the Butte Superior Court against Mary's Gone Crackers Inc. and Does 1 through 25 alleging breach of contract.

According to the complaint, on Feb. 1, 2016, plaintiffs entered into a written agreement of lease for a portion of a property in Gridley with the defendants, wherein defendants agreed to a three-year term with a minimum rent of $660,000 per year. 

The plaintiffs allege the defendants breached the lease by paying only $45,000 per month instead of $55,000 per month.

The plaintiffs hold Mary's Gone Crackers Inc. and Does 1 through 25 responsible because the defendants allegedly failed to pay the full rent owed under the lease.

The plaintiffs seek judgment for damages no less than $374,000, plus litigation expenses, costs, attorneys' fees, pre- and post-judgment interest, and such other and further relief, legal and equitable, as the court deems just and proper.
