Pedestrian alleges San Francisco failed to fix storm grate that injured foot

SAN FRANCISCO – A pedestrian alleges the city and county of San Francisco failed to repair a storm grate that injured her left foot.

Frances Nkara filed a complaint on Feb. 13 in the San Francisco Superior Court against the city and county of San Francisco alleging premises liability and general negligence.

According to the complaint, on April 8, 2018, Nara was walking on Eighth Avenue approaching the intersection of Irving Street when her left foot fell through a hazardous and damaged hole in the storm grate of the crosswalk, causing her injury. The suit states the storm grate is controlled, owned and managed by the defendants.

The plaintiff holds the city and county of San Francisco responsible because the defendants allegedly knew or should have known of the condition and failed to make repairs.

The plaintiff seeks judgment for compensatory damages, costs of suit, and for such relief as is fair, just, and equitable. She is represented by Sandhya K. Forouzin and Brian J. Graziani of Sisneros Graziani LLP in San Francisco.
