Wrongful death suit filed by parents whose son was shot at Santa Teresa light-rail station

SAN JOSE - The parents of a deceased Santa Clara County man seek judgment in the Santa Clara Superior Court after their son was shot and killed by security officers during a mental breakdown, according to documents filed on Jan. 21. 

Plaintiffs John and Joan Malloy say their 49-year-old son, Brent, who had no past history of violence, was suffering a mental break at the Santa Teresa light-rail station when two Universal Security Services officers breached basic protocol. One officer fatally shot Brent four times, the suit says. 

The security company was employed by the Santa Clara Valley Transportation Authority. 

The plaintiffs say that the Santa Clara County Sheriff's Office has refused to disclose any facts or repots about the incident to them, and the Santa Clara District Attorney decided not to prosecute the security guard. 

The Malloys charge Universal Security Services and the Santa Clara Valley Transportation Authority with wrongful death and negligent hiring, supervision and retention. They are seeking damages including medical and funeral expenses, emotional anguish, loss of income, litigation fees and other restitution determined in judgment. 

The plaintiffs are represented by Maryanne Cooper of Emison Cooper and Cooper LLP.
