Almaden Golf and Country Club accused of gender discrimination against employees

SAN JOSE - Accusations of gender discrimination, harassment and retaliation were leveled against the Almaden Golf and Country Club in a January 4 Santa Clara County Superior Court lawsuit. 

Plaintiff Jomar Lacsina is a 42-year-old female who was hired by the country club as a server in 2016. Lacsina is a member of the LGBTQ+ community. She says that her assistant manager, defendant Rigo Headley, discriminated against and harrassed her for her gender identity and sexual orientation, using slurs and other offensive statements when speaking about her to others. 

The plaintiff alleges that when she voiced a concern about tip withholding to Headley, he retaliated against her by reducing her shifts on the weekly schedule until she was not scheduled to work at all. The country club has allegedly not paid Lacsina her last paycheck and has not responded to her attempts to understand what happened to her employment. 

The defendants are charged with gender identity discrimination in employment, harassment in employment, violation of whistleblower protection and failure to prevent discrimination, retaliation or harassment. The plaintiff requests economic damages as well as compensation for her emotional and mental distress.
