Relying on this information, he decided to play but later discovered an additional charge labeled as "Employee Health & Benefits Fee" amounting to $1.44 had been added to his bill without prior notice or consent. This fee increased the total cost per person to $18.72 instead of the advertised $18.
Xue argues that this practice violates several California laws including Business and Professions Code §§ 17200 et seq., which prohibits unlawful and fraudulent business acts; Business and Professions Code §§ 17500 et seq., which addresses false advertising; and the Consumer Legal Remedies Act (CLRA), Civil Code §§ 1750 et seq., which protects consumers from deceptive practices. The plaintiff asserts that these actions harm both consumers and competitors by creating a false impression of lower prices.
The plaintiff seeks injunctive relief to prevent further violations by the defendants, an order for refunds to affected customers including himself, coverage for legal costs such as filing fees and service process fees, and any other relief deemed appropriate by the court.
