A kitchen appliance manufacturer was hit with a class action lawsuit on March 25 in the San Francisco County Superior Court for allegedly violating the Song-beverly Consumer Warranty Act, Unfair Competition Law.
According to the complaint filed by plaintiff and class representative Michael Spórn, defendant Midea America Corporation manufactured a toaster that Spórn purchased.
The plaintiff alleges that the toaster's product registration card was misleading in stating that the card could be filled out with plaintiff's information to secure the benefits of the warranty that was displayed as included with the product.
The registration card was not actually required to protect warranty rights, according to the defendant's website, and the personal information collected from consumers was used for marketing purposes.
Spórn accuses Midea America of violating the California Song-Beverly Consumer Warranty Act, violating the California Consumer Legal Remedies Act and violation of California Unfair Competition Law.
Spórn demands a trial by jury for the class of effected consumers through his representation, Kazerouni Law Group APC of St. George UT.
