SAN FRANCISCO - A fatal visit to an Airbnb resulted in charges against the vacation rental company from the decedent's estate.
The complaint was filed on April 13 in the San Francisco County Superior Court by plaintiff Martin Kraus as estate representative of Peter J. Kraus against the following defendants: Airbnb Inc., Airbnb Payments Inc., Rinnai Corp. d/b/a Rinnai America Corp., and rental property owners Barry Brachfield, Bruce Resnick, Nora Escobar d/b/a Publado Rentals.
The decedent was staying at an Airbnb rental located in El Poblado, Colombia, when he died on April 11, 2019, from carbon monoxide poisoning, the suit says.
According to the complaint, the poisoning source was a tankless water heater installed in the bedroom where Kraus was sleeping. Due to the lack of a carbon monoxide detector, Kraus was unaware of the dangerously defective condition of the heater, the suit says.
The defendants are charged with: wrongful death, premises liability, negligence, fraud/deceit/intentional misrepresentations, breach of fiduciary duty, violation of the Consumers Legal Remedies Act and many other charges.
