Prop 65 group sues Burt's Bees over diaper rash ointment

SAN FRANCISCO -- The Center for Advanced Public Awareness has sued a company for toxic materials allegedly being leaked into drinking water. 

The Center for Advanced Public Awareness filed a complaint on April 28 in San Francisco Superior Court against Burt's Bees for alleged violation of Proposition 65, The Safe Drinking Water and Toxic Enforcement Act of 1986. 

The CAPA alleges that Burt's Bees continually failed to warn individuals and consumers about being exposed to substances known to cause cancer, birth defects and other reproductive harm through exposures to lead present in diaper rash ointments manufactured, distributed, imported, marketed, sold and otherwise offered for sale to be purchased by consumers and applied to the skin. 

CAPA alleged that detectable levels of lead are found in diaper rash ointments manufactured, imported, sold or distributed for sale to individuals by Burt's Bees, Inc. 

The CAPA seeks the court forcing Burt's Bees to provide a "clear and reasonable warning" regarding the harms associated with lead exposure and attorney's fees and costs of suit. The CAPA is represented by Kimberly Gates Johnson of Seven Hills LLP.
