A major class action lawsuit has been filed against a Texas-based company, accusing it of widespread labor violations affecting numerous employees in California. On February 21, 2025, Abel Lemuz Sanchez filed the complaint in the Superior Court of California, County of Santa Clara, targeting American Builders & Contractors Supply Co., Inc., ABC Supply Co., Inc., and several unnamed defendants.
The lawsuit alleges that the defendants engaged in multiple violations of the California Labor Code and unfair business practices. According to Sanchez, who worked for the company from March 2024 to December 2024, these infractions include failing to pay minimum and overtime wages, not providing required meal and rest breaks, neglecting to maintain accurate records of hours worked, and not reimbursing necessary business expenses. "Defendants maintained a systematic policy and practice," states the complaint, which resulted in employees working off-the-clock without compensation and being denied legally mandated breaks.
Sanchez is bringing this case on behalf of himself and other similarly situated current and former employees classified as hourly-paid non-exempt workers. The lawsuit claims that the company's practices violated various sections of the California Labor Code including §§ 204, 1194, 1197 for wage payments; §§ 226.7, 512 for meal periods; § 2802 for expense indemnification; §§ 201-203 for timely payment upon termination; § 226 for wage statements; and §17200 under the Business & Professions Code for unfair business practices.
The plaintiff seeks several forms of relief from the court. These include unpaid wages with interest, liquidated damages under Labor Code section 1194.2 for failure to pay minimum wages, penalties for inaccurate wage statements under section 226(e), statutory penalties under section 203 for late payment upon termination, reimbursement of business expenses with interest under section 2802(b), injunctive relief to prevent future violations, restitution under Business & Professions Code §§17200 et seq., as well as attorneys' fees and costs.
