SAN FRANCISCO -- A man is suing a company, in public interest, and claims the company failed to warn individuals about harmful material in its products.
My Nguyen filed a complaint on April 10 in the Superior Court of California County of San Francisco against Pasco Specialty and Manufacturing, Inc. and Does 1-30 for Violation of Proposition 65, The Safe Drinking Water and Toxic Enforcement Act of 1986.
Nguyen alleges that Pasco Specialty and Manufacturing, Inc. has been selling hazardous diisononyl phthalate (DINP), a toxic chemical found in and on vinyl tape, to consumers without warning people about the health hazards associated with exposure to DINP. Nguyen says the chemical is known to cause cancer.
Nguyen seeks the for the court to permanently enjoin Pasco Speciality and Manufacturing, Inc. from manufacturing, distributing, importing or selling the vinyl tape without first warning customers and for all products to be recalled. Nguyen also seeks attorney's fees and costs of suit. Nguyen is represented by Kimberly Gates Johnson of Seven Hills LLP.
