REDWOOD CITY -- A woman claims that her house was left damaged and equipment was left behind after hiring a company to clear her home of asbestos.
Carol Lockerby filed a complaint on June 2 in San Mateo Superior Court against Synergy Enterprises, Inc., and Does 1-30 for negligence, breach of contract, breach of implied covenant of good faith and fair dealing, breach of expressed warranty, breach of implied warranty, negligent infliction of emotional distress and unlawful business practices.
According to the complaint, Lockerby signed a contact with Synergy on June 11, 2018, for the company to perform asbestos abatement and paid a down payment of $607.40 of a $6,074 total.
The job allegedly began on June 25, 2018, and was to be completed by June 27, 2018. David Lockerby, Carol Lockerby's son, discussed with Juan, the site manager, about placing an industrial contamination shower and attaching protective plastic curtain to the walls in a way that would minimize damage, especially to the custom-painted walls, the suit says.
On June 28, 2018, Carol Lockerby received a phone call that it was it safe to go back into the house, and upon return, she found the job had not been completed, saw significant damage to the walls and ceiling, equipment was left behind and trash was both inside and outside the home, the suit says.
On June 29, 2018, two crew members were sent by Edgar Cuevas, Operations Manager, to complete the job. On July 3, 2018, Jake Holt and the Lockerbys met at the site to review damages and consider solutions. On July 12, 2018, Lockerby hired a contractor to try to repair some of the damage and was unable to, the suit claims.
On August 2, 2018, Lockerby emailed Jenni Miller, Synergy's general manager, about performance failures of the company. Lockerby again emailed Miller on October 10, 2018, and did not hear back from the company except for one email in March 2019, the suit claims.
Lockerby seeks general damages, special damages, punitive damages, costs of suit and attorney fees. Lockerby is represented by Jeffery R. Windsor.
