San Jose sued by woman who wanted refund because Paul McCartney concert was too loud

SAN JOSE — A San Francisco woman is suing the City of San Jose, along with a police officer, for unlawful assault and battery.

Deborah Whiting filed the lawsuit against the city, and Officer Jenni Byrd, on July 7 in the United States District Court for the Northern District of California.

According to the lawsuit, on July, 10, 2019, Whiting, who was 66 at the time, attended a Paul McCartney concert at the SAP Center when she decided to leave because the music was too loud.

Whiting inquired about a refund and was directed to a stairwell by SAP staff worker because the conversation was inaudible due to the volume of the concert, the suit says.

The lawsuit claims that Officer Byrd inquired about Whiting wanting a refund, but was ignored and “grabbed (Whiting) from behind and threw her against the stairs causing injury and harm."

Whiting is seeking compensation related to the alleged assault and is being represented by James McManis with the local law firm McManis Faulkner.
