Doctor molested little girl in front of mother, lawsuit alleges

FRESNO -- A woman is suing a health center, alleging her child was sexually assaulted by doctor in exam room

Mayra P., by and for K.A. has filed a federal complaint on July 20 in the U.S. District Court for the Eastern District of California against Clinica Sierra Vista, Federally Qualified Health Center, Dr. Dmitri De La Cruz, Kathleen Kalfman and the United States for sexual harassment, and other claims.

According to the complaint, K. A. was under the age of five when her mother took her to the Elm Women’s & Pediatric Community Health Center as part of a physical examination in preparation for her to go into kindergarten. Mayra P. alleges that it is at that time her child was physically and sexually assaulted by De La Cruz. 

Mayra P. alleges that Cruz entered the examination room, shut the door behind him, and instructed Mayra to lift the dress of K. A. then began rubbing her pubic area and vagina.

"De Law Cruz then inserted two ungloved fingers into the five-year-old K.A.’s vagina and asked Mayra P. in Spanish if she had told K.A. to give her vagina a name," the suit alleges.

Mayra P. seeks general damages, special damages, cost of suit and attorney's fees. Mayra P. is represented by Micha Star Liberty.
