A group of plaintiffs is taking a bold stand against their former legal representatives, alleging gross incompetence and misconduct. Victoria Golunova, Martya Rychkova, Andrey Rychkov, and Igor Lyustin filed a complaint on February 28, 2025, in the Superior Court of California, County of San Francisco, accusing Ongaro PC and David Ongaro of professional negligence, breach of fiduciary duty, and fraudulent misrepresentation.
The plaintiffs claim that the defendants' deficient representation in a previous case caused them significant harm. The lawsuit centers around an earlier action titled "Golunova vs. Akromtsevs," where the plaintiffs allege that Ongaro PC failed to meet the expected standard of care for legal professionals. According to the complaint, the defendants were negligent in preserving critical evidence during trial and missed key deadlines for filing motions for fees and costs. This alleged negligence resulted in financial harm to plaintiff Andrey Rychkov and impacted the plaintiffs' ability to appeal or collect compensation.
Moreover, the plaintiffs assert that Ongaro PC breached its fiduciary duty by failing to conduct proper research and analysis regarding their claims. They accuse the firm of filing frivolous motions that led to unnecessary fees and improperly staffing their case. The plaintiffs also allege that Ongaro PC refused to release their client files as required by California State Bar Rules, further concealing deficiencies in their representation.
The complaint also accuses Ongaro PC of fraudulent misrepresentation by providing false legal advice that persuaded the plaintiffs to pursue an unwinnable appeal. This alleged misconduct resulted in severe financial harm and legal prejudice for the plaintiffs.
In seeking relief from the court, the plaintiffs are asking for compensatory damages for their losses due to professional negligence and breaches of fiduciary duty. They are also demanding disgorgement of all fees paid to Ongaro PC amounting to nearly $600,000. Additionally, they seek special damages as permitted by law and any other relief deemed necessary by the court.
