Alameda County sued over alleged police brutality

OAKLAND - JoLynn McCabe filed a federal complaint on September 17 in the Northern District of California against Alameda County and Does 1-25 for excessive force, battery and negligence.

According to the complaint, on September 13, 2020, officers of the Fremont Police Department arrived at McCabe’s home after her husband called 911 to request an ambulance for her. From her front yard, McCabe told officers she did not need assistance. 

When she took a step onto the sidewalk, officers allegedly arrested her for public intoxication. McCabe was then transported to Santa Rita Jail where she experienced a panic attack and requested the officer give her a moment to calm down before being placed in the tiny holding cell, the suit says. 

Deputies ignored her and forced her into the cell by using part of a take-down maneuver and slamming her head and face into the concrete, which resulted in significant bruising and swelling in both eye sockets, the bridge of her nose, and her forehead, the suit says. She says she then had to be transported to the hospital to be treated for her injuries. 

McCabe seeks relief for general, special and punitive damages, other damages, penalties, costs, interest and attorney's fees. McCade is represented by Patrick Buelna.
