Kombucha called Health-Ade sued for not aiding health

SAN FRANCISCO - Brandon Johnson-Jack and Michael Xavier filed a federal class action complaint on October 7 in the Northern District of California against Health-Ade LLC.

According to the complaint, Health-Ade has marketed and sold a line of kombucha or kombucha-inspired beverages branded as “Health-Ade” for several years. Plaintiffs allege that by branding the products in this manner, Defendant expressly represents that the Health-Ade Beverages will aid health. 

Plaintiffs allege that because the beverages actually contain a high amount of sugar, Health-Ade's representations are false and misleading, since consuming beverages sweetened with high amounts of added sugar, like the Health-Ade beverages, increases the risk of metabolic disease, cardiovascular disease, type 2 diabetes and liver disease.

Plaintiffs seek a court order requiring Health-Ade LLC to conduct a corrective advertising campaign, destroy all misleading and deceptive advertising materials, labels and products, disgorge all monies and profits earned by wrongful acts or practices, pay restitution, compensatory damages, punitive damages, attorney's fees and cost of suit. Plaintiffs are represented by Paul K. Joseph.
