Lawsuit over RV rental alleges misrepresentation about insurance

SAN FRANCISCO - A man claims to have been misled by Outdoorsy's website about insurance coverage when renting an RV.

Zach Resnick filed a class action lawsuit on Jan. 19 in the San Francisco County Superior Court against Outdoorsy, Inc. and Does 1-10 for violations of the California Civil Code 1750, California Business and Professional Code 17200 and breach of contract.

According to the lawsuit, in July 2021, Resnick visited Outdoorsy's website to rent an RV. As part of the rental agreement, the website claimed that insurance protection of $1 million was included to protect the renter, owner and vehicle, the suit says. Resnick was involved in a motor vehicle accident while in the RV and discovered the RV did not have any insurance, the suit says.

Resnick claims that Outdoorsy is in violation of state law by stating on its site that insurance is covered in the rental but the company does not have the vehicles insured. 

Resnick is represented by David R. Sidran.
