IBM sales rep sues his employer for allegedly capping his commissions

IBM sales representative, Kami Nazem, has filed a lawsuit against his employer accusing the tech giant of illegally capping his commissions. 

The suit alleges that IBM has engaged in an institutional bait-and-switch regarding its commission payments to sales representatives. 

Despite public assurances from IBM stating that commissions are uncapped, Nazem claims that the company frequently caps commissions to limit income, according to the complaint.

The complaint further alleges that IBM intentionally misleads its sales representatives about the program as an "uncapped commissions" program is highly motivating and incentivizes them to pursue big deals. However, when they reach the cap, they can't earn any more commissions regardless of how big the deal is.

Nazem accuses IBM of not attempting to clarify its real practice due to profit motives. He claims that IBM motivates its sales team to pursue big deals but allegedly doesn't pay a fair commission for the effort expended to close it.

Nazem seeks to recover damages incurred from IBM's alleged wrongful capping of his sales commissions and aims to put an end to what he describes as IBM's deceptive, discriminatory, and unlawful practices.

Nazem is represented in the case by attorney Alex M. Straus, of the firm of Milberg Coleman Bryson Phillips Grossman, of Beverly Hills.
