Class action accuses Purple Innovation of allegedly advertising mattresses on sale, when they allegedly aren't

Online mattress retailer, Purple Innovation, has been hit with a class action lawsuit for allegedly misleading customers by advertising their products at "sale prices" when they are not actually discounted. 

The lawsuit was filed Jan. 17 in San Francisco County Superior Court  by plaintiffs Mason Julian and Alexander Tat, on behalf of all others allegedly similarly situated.

The complaint alleges that Purple Innovation is capitalizing on the booming online mattress market, which generated nearly $5.2 billion in 2021 alone, by offering perpetual "sales" and discounted prices through its online e-commerce store. The company is accused of intentionally misleading consumers about the quality and value of their merchandise through deceptive sales tactics.

The plaintiffs claim that Purple Innovation never actually sells its products at the advertised strike-through price. This was reportedly confirmed through online archives documenting the company's pricing and sale history. As a result of these alleged false and misleading sales practices, the plaintiffs argue that they and other class members were induced into purchasing products under the false premise that they were of a higher grade, quality, or value than they actually were.

The lawsuit seeks relief for violations of California consumer protection laws, as well as for allegations of fraud and unjust enrichment. The plaintiffs are seeking actual and statutory damages, restitution, injunctive relief, and attorneys' fees.

The plaintiffs are represented by attorney Neal J. Deckant, of Bursor & Fisher, of Walnut Creek.
