Progress Software Corporation and Delta Dental of California are facing a class action lawsuit for allegedly failing to prevent hackers from accessing private personal information of patients. The lawsuit was filed by named plaintiff Shannon Lechele Harker on behalf of herself and others similarly affected.
The plaintiff alleges that Progress Software Corporation's inadequate data security allowed cybercriminals to breach their systems around June 1, 2023. The perpetrators are believed to be part of the Clop crime group.
Delta Dental of California, a leading dental insurance provider serving over 45 million people across 15 states, is accused of using Progress Software's MOVEit service to transfer or store its clients' sensitive information, which was subsequently stolen.
The compromised data reportedly includes personal identifying information such as individuals' names, health insurance details, and treatment information. The defendants are accused of negligently maintaining this sensitive data, making it an easy target for cybercriminals.
Harker seeks to hold both defendants responsible for the injuries inflicted on her and millions of other class members due to the alleged data breach.
The case has been filed in the U.S. District Court for the Northern District of California.
Plaintiffs are represented in the action by attorneys Michael F. Ram, John A. Yanchunis and Ronald Podolny, of the Morgan & Morgan Complex Litigation Group, of San Francisco and Tampa, Florida.
