Shirley N. Weber sues Vince Fong for violating the Elections Code

Shirley N. Weber, Secretary of State, has filed a lawsuit against Vince Fong and the Superior Court of Sacramento County in the Third Appellate District Court of California (Case ID: C100304) on April 9, 2024. The case revolves around Fong's filing nomination papers for two different offices for the March 5, 2024 primary election.

Represented by Attorney General Rob Bonta and his team, Weber argues that Fong violated Section 8003 of the Elections Code by filing nomination papers for both California Assembly District 32 and Congressional District 20. However, Fong's lawyers from Bell, McAndrews & Hiltachk claim that Section 8003 only applies to independent nominations.

Weber is seeking a reversal of the superior court’s decision which allowed Fong to run for both offices. She insists that the statute applies to all candidates regardless of their nomination process.
