Harold Malmquist sues City of Folsom for supplying corrosive water causing property damage

The lawsuit filed by Harold Malmquist against the City of Folsom in the Court of Appeal of the State of California, Third Appellate District (Sacramento), with court case ID C099011, on April 17, 2024, is about a nuisance action related to alleged damage caused by corrosive water supplied by the city. The plaintiff appealed from an order denying class certification in this case.

Malmquist alleges that between July 2017 and July 2020, the City failed to maintain proper corrosion control measures at its water treatment plant. As a result, he claims that the pH level of its water consistently rose above 9, causing it to become corrosive and harmful. This resulted in pinhole leaks in copper pipes which allegedly damaged persons and properties.

In March 2021, Malmquist filed this class action against the City. He sought class certification based on the theory that highly aggressive corrosive water treated and supplied by the City's plant created a public nuisance by causing pinhole leaks damaging residents' properties plumbed with copper piping.
