Pacific Bell Telephone Company dba AT&T California sues California Utility Company for property damage

In the Superior Court of California, County of Santa Clara, Pacific Bell Telephone Company dba AT&T California (hereinafter referred to as AT&T) has filed a lawsuit against California Utility Company and Does 1 to 10, inclusive. The case number is 24CV435344 and was filed on April 15, 2024. The suit alleges property damage in the amount of $68,173.64.

The plaintiff's attorney is Bradley A. Weise from the Law Office of Bradley A. Weise, P.S. According to the filing, on August 10, 2022, during excavation operations conducted by the defendants, AT&T's underground conduits, cables and other facilities located at or near 411 N. Pastoria Ave, Sunnyvale were damaged.

AT&T claims that this damage was due to negligence on part of the defendants who failed to act with due care during their operations causing direct costs for removing and replacing the damaged subsurface facilities as well as indirect costs and overhead expenses totaling no less than $68,173.64.

AT&T seeks judgment against the defendants for damages caused by negligence and negligence per se according to California Government Code Sections 4216 et seq., which they allege were violated by the defendants' failure to comply before commencing excavations.
