Ivan Andrew Humphrey sues Hyundai Motor America for violation of statutory obligations under the Song-Beverly Consumer Warranty Act

Ivan Andrew Humphrey has filed a lawsuit against Hyundai Motor America in the Superior Court of California, County of Santa Clara. The case, identified as 24CV435500, was filed on April 16, 2024. The plaintiff is represented by Eleazar D. Kim and Matt Xie from Downtown L.A. Law Group.

The complaint revolves around a 2019 Hyundai Ioniq that Humphrey purchased on December 5, 2018. According to the court documents, the vehicle developed multiple defects that significantly impaired its use, safety, and value. These defects included issues with the body system, powertrain system, safety system, electrical system, braking system and noise system.

Despite providing Hyundai Motor America with ample opportunities to service or repair the vehicle within the warranty period, Humphrey alleges that the company was unable or failed to do so within a reasonable number of attempts. The total amount paid for the vehicle and consequential damages exceeds $25,000.

Humphrey is seeking judgment for violation of statutory obligations under the Song-Beverly Consumer Warranty Act CA Civil Code §§ 1790-1795.8. He demands a jury trial for his case.
