Kathy Saray Mejia Martinez sues Seadrift Seafood Inc. for alleged labor law violations

In the Superior Court of California, County of Santa Clara, plaintiff Kathy Saray Mejia Martinez, represented by Parviz Darabi of Law Offices of Parviz Darabi, has filed a lawsuit against Seadrift Seafood Inc., also known as The Boiling Crab, and individual Javier Gonzalez. The case ID is 24CV435504 and was filed on April 16, 2024.

Martinez alleges multiple violations including failure to pay overtime wages, minimum wages, indemnify for expenses and losses in discharging duties, provide meal periods and rest periods. She also accuses the defendants of not maintaining accurate itemized wage statements and not paying wages due upon termination. Furthermore, she alleges unfair business practices, retaliation, wrongful termination in violation of public policy and FEHA (Fair Employment and Housing Act), failure to provide reasonable accommodation under FEHA, failure to engage in the interactive process under FEHA and sexual harassment.

The plaintiff is seeking damages for these alleged violations. She claims that these actions have caused her significant harm both financially and emotionally. In addition to monetary compensation for her losses, she is demanding a jury trial.
