Alberto Javier Elias Fernandez sues Debt Collectors International for violating the California Rosenthal Fair Debt Collection Practices Act

In the Superior Court of California, County of Santa Clara, Alberto Javier Elias Fernandez has filed a class action lawsuit against Debt Collectors International, Inc., a Florida corporation; Debt Collectors International, Inc., a Georgia corporation; Anthony Emil Pellino, individually and in his official capacity; and Does 1 through 10. The case was filed under court case ID 24CV436821 on April 26, 2024.

Represented by attorneys Fred W. Schwinn, Raeon R. Roulston, and Matthew C. Salmonsen from Consumer Law Center, Inc., Fernandez alleges that the defendants have violated the California Rosenthal Fair Debt Collection Practices Act (RFDCPA) and failed to provide a "Consumer Collection Notice" as required by California Civil Code §§ 1812.700-1812.702. The plaintiff claims that the defendants' initial written communications lacked the necessary information and notices mandated by California Civil Code §§ 1788.11(f), 1788.14.5(e)(1), and 1812.700(a).

Fernandez seeks statutory damages for himself and all others similarly situated due to the defendants' alleged unlawful practices in their attempts to collect delinquent and defaulted consumer debts.
