In the Superior Court of California, County of Santa Clara, Alberto Javier Elias Fernandez has filed a class action lawsuit against Debt Collectors International, Inc., a Florida corporation; Debt Collectors International, Inc., a Georgia corporation; Anthony Emil Pellino, individually and in his official capacity; and Does 1 through 10. The plaintiff claims that the defendants' initial written communications lacked the necessary information and notices mandated by California Civil Code §§ 1788.11(f), 1788.14.5(e)(1), and 1812.700(a).
Fernandez seeks statutory damages for himself and all others similarly situated due to the defendants' alleged unlawful practices in their attempts to collect delinquent and defaulted consumer debts.
