Plaintiff Accuses Defendants of negligence in San Jose car accident

This distraction led him to run a red light and collide with Olivera's Toyota Tacoma. The impact pushed Olivera's vehicle into Vides' car.

The complaint asserts that both defendants failed to operate their vehicles safely and reasonably. It specifically mentions that Contreras violated California Vehicle Code § 21453 by not stopping at the red light. This statute is designed to protect motorists from collisions at intersections. "Defendants knew or should have known that failing to perform these tasks created an unreasonable risk of injury," the document states.

Vides claims significant injuries as a result of this incident and is seeking various forms of relief from the court. He demands repayment for all special damages incurred, including past and future wage loss and medical expenses. Additionally, he seeks general damages according to proof, prejudgment interest as allowed by law, costs of suit incurred herein, and any other relief deemed just and proper by the court.
