Man sues couple over negligence resulting from car collision

In a recent court filing, James Phung has lodged a complaint for negligence against Justin Fleury and Carol Fleury. The complaint was filed on May 14, 2024, in the Superior Court of California, County of Sacramento.

According to the details provided in the case, Phung alleges that on November 2, 2023, Justin Fleury and Carol Fleury were involved in an automobile collision with him while operating a 2015 Nissan Sentra bearing California License plate number 7NSY647. The incident occurred on Southbound I-5, approximately 1721 feet south of Arena Blvd., when the defendants allegedly violated California Vehicle Code section 22350 by driving at an unsafe speed given the traffic conditions. This violation purportedly led to their vehicle colliding with Phung's vehicle.

Phung claims that both Justin and Carol Fleury were residents of Sacramento County and either owned or had control over the vehicle at the time of the accident. Furthermore, he asserts that their negligent actions caused him significant physical injuries and emotional distress. "As a legal result of the violation of the above-referenced statute and of the negligence and carelessness of defendants," Phung states in his complaint, "Plaintiff was injured in his health, strength, and activity, sustaining injury to his body and shock and injury to his nervous system."

The plaintiff also contends that due to this collision, he has incurred substantial medical expenses for treatment and will continue to require medical attention. Additionally, Phung reports experiencing lost earnings and other economic damages as a result of being unable to work during his recovery period. He is seeking compensation for these losses along with general damages for pain and suffering.

In terms of relief sought from the court, Phung is requesting judgment against both Justin Fleury and Carol Fleury for all general compensatory damages as well as non-economic damages. He also seeks reimbursement for medical expenses already incurred and those anticipated in the future. Moreover, he demands compensation for lost earnings due to time away from work because of his injuries. Further claims include property damage resulting from the collision, loss of use damages related to his vehicle, consequential damages stemming from these events, prejudgment and post-judgment interest on any awarded amounts, reasonable attorney fees incurred during litigation, as well as any additional relief deemed appropriate by the court.
