Plaintiff sues Target Corporation over premises liability

On May 22, 2024, Delmy Quant filed a complaint for damages against Target Corporation in the Superior Court of California, County of San Francisco. The lawsuit, which includes allegations of premises liability and general negligence, was officially recorded by Deputy Clerk Shenequa Gladney under Case No. CGC-24-614890.

The incident that led to the filing occurred on May 23, 2022, at a Target store located at 2675 Geary Blvd., San Francisco. According to the complaint, Quant tripped over an empty wire basket container left on the aisle floor while she was shopping for eyebrow pencils. The fall resulted in significant injuries as she first landed on her right knee and then fell forward onto her right shoulder while attempting to avoid hitting her head.

Quant alleges that Target Corporation, along with unnamed defendants referred to as Does 1 through 50, failed in their duty to maintain a safe environment for customers. "Defendants took no steps to correct the dangerous condition and negligently directed Plaintiff and others to use the location despite being aware of the dangerous condition of the Premises," states the complaint. It further asserts that all defendants were responsible for maintaining control over the property and ensuring it was free from hazards as required under California Civil Code §1714(a).

The plaintiff's legal representation from Deldar Legal argues that Target Corporation's negligence created an unreasonable risk of harm. "Defendants also failed to take reasonable steps to inspect, repair, replace, or give adequate warning of the dangerous and unsafe condition," reads another excerpt from the filing. As a result of this alleged negligence, Quant claims she has incurred substantial medical expenses and suffered permanent harm.

Quant is seeking various forms of relief including past and future special damages for medical expenses and lost wages, general damages for pain and suffering, interest allowable by law, costs associated with bringing the suit, and any other relief deemed appropriate by the court.

Representing Delmy Quant are attorneys P. David Cienfuegos (SBN 225394) and Mona Deldar (SBN 231393) from Deldar Legal based in Los Angeles. The case will be heard in front of judges assigned by the Superior Court of California in San Francisco County.
